These terms govern your use of the Tepak Sirih website and any services you engage with us. By accessing the website or submitting an enquiry, you accept these terms.
1. Definitions
- "The Firm" means Tepak Sirih, a legal practice registered in Malaysia and based in Kuala Lumpur.
- "User" or "you" means any person who accesses this website or contacts the Firm.
- "Client" means a person who has entered into a formal engagement agreement with the Firm.
- "Services" means the legal services offered by the Firm, as described on this website.
- "Website" means the site accessible at tepaksired.world.
- "Agreement" means the engagement letter or written confirmation issued by the Firm upon commencement of a service.
2. Acceptance of Terms
By using this website or engaging the Firm's services, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are acting on behalf of another person or organisation, you confirm that you have authority to bind that party to these terms.
3. Nature of Services
The Firm offers three legal services: the Initial Family Letter (RM 320), the Application for Sole or Joint Custody (RM 730), and the Settled Family Legal Plan (RM 980). Each service is described on the Website. The scope of each service is defined in the engagement letter issued at the start of a formal engagement.
The Website contains general information only and does not constitute legal advice. No solicitor-client relationship is formed until the Firm issues a written engagement letter.
4. Fees and Payment
- All fees are stated in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless stated otherwise.
- Fees are fixed as stated and will not increase during an engagement unless a change of scope is agreed in writing by both parties.
- Payment terms are set out in the engagement letter. The Firm accepts bank transfer and other methods as agreed at commencement.
- For the Settled Family Legal Plan, payment arrangements may be staged across sessions as agreed.
5. Service-Specific Terms
Initial Family Letter: The Firm will draft one letter based on information provided by the client. The client must review and approve the draft before it is issued. The fee covers one round of revisions; additional revisions may be charged separately.
Custody Application: The Firm will prepare and file the application and attend hearings as required. The client is responsible for providing all relevant documents and information in a timely manner. Delays caused by the client may affect the timeline of the matter.
Settled Family Legal Plan: Sessions may be paused and resumed at the client's request. The fixed fee covers the full engagement regardless of the number of sessions, provided the scope remains as agreed. A change of scope requires a new written agreement.
6. User Responsibilities
- Provide accurate and complete information to the Firm.
- Respond to requests for documents or information within a reasonable time.
- Use the Website only for lawful purposes and in a manner consistent with these terms.
- Not use the Website to submit false, misleading, or defamatory information.
7. Intellectual Property
All content on this Website — including text, layout, and design — is owned by or licensed to the Firm. You may not reproduce, distribute, or republish any content without prior written consent from the Firm. Documents drafted on your behalf in the course of an engagement remain the property of the Firm until fees are settled in full.
8. Disclaimers
The Website and its contents are provided for general informational purposes only. Nothing on this Website constitutes legal advice or creates a solicitor-client relationship. The Firm makes no representation about the outcome of any legal matter.
Legal outcomes depend on facts and circumstances specific to each matter and cannot be predicted with certainty. The Firm will provide honest assessments but does not make representations about results.
9. Limitation of Liability
To the extent permitted by Malaysian law, the Firm's liability to you in connection with any service is limited to the fee paid for that service. The Firm is not liable for indirect, consequential, or incidental losses arising from your use of the Website or the Firm's services. This does not limit liability for negligence, fraud, or other matters where limitation is not permitted by law.
10. Termination
Either party may terminate an engagement by giving written notice. If the client terminates before completion, the Firm will charge for work completed to that point, up to a maximum of the agreed fee. If the Firm terminates for legitimate professional reasons, fees will be apportioned to work completed and any overpayment refunded.
11. Dispute Resolution
These terms are governed by the laws of Malaysia. Any dispute arising from these terms or from an engagement with the Firm will be subject to the jurisdiction of the courts of Malaysia. 12. Changes to These Terms
The Firm may revise these terms from time to time. Changes will be posted on this page with a revised effective date. Continued use of the Website following any change constitutes acceptance of the revised terms.
